Information cancellation right
RIGHT TO CANCEL UNDER PART 3 OF THE CONSUMER CONTRACTS (INFORMATION, CANELLATION AND ADDITIONAL CHARGES) REGULATIONS 2013 (the “Regulations 2013”)
INFORMATION
1. If your contract with a Notary was concluded without a simultaneous physical presence of the parties with the exclusive use of distance communication (“distance contract”), or in the simultaneous presence of the parties but in a place which is not the business premisses of a Notary (“off-premises contract” ), you have a right to cancel the contract. (For full definition see regulation 5 of the Regulations 2013)
2. You may cancel the contract at any time within a period of 14 days from the date of the conclusion of the contract (the “Cancelation period”). This provision is subject to paragraph 9(A).
3. To meet the cancellation deadline, it is sufficient for you to send your communication concerning your exercise of the right to cancel before the Cancelation period expired.
4. You do not need to give any reason for the cancelation, and you will not incur any liability, unless you requested from a Notary an early supply of services, i.e., to commence before the end of the Cancelation period.
5. You must inform a Notary at -Wozniak Notary of 63 St. Mary Axe, 1st Floor, the City of London, EC3A 8AA, email kate@wozniaknotary.co.uk – of your decision to cancel the contract before the end of the Cancelation period. To do so, you may either:
a) use a form, attached, or
b) make, on a durable medium (paper or mail), any other clear statement setting out your decision to cancel the contract.
6. A Notary will acknowledge receipt of the cancelation referred to in paragraph 4, without delay.
7. The cancellation ends the obligations of the parties to perform the contract.
8. A Notary will reimburse all payments received from you, without undue delay; in any event within 14 days from the day of receipt of the cancelation. This provision is subject to paragraph 9(B).
9. A) If you requested to commence my services before the end of the Cancellation period, you will have ceased to have the right to cancel the contract if my services were fully performed in response to the request.
B) Where my services were performed in response to your request referred to in paragraph 9(A), you must pay me an amount calculated on the basis of the total price agreed in the contract in proportion to what has been performed until you have communicated me your cancellation.
10. A Notary will make the reimbursement using the same means of payment as you used for the initial transaction unless you have expressly agreed otherwise; in any event, you will not incur any fees as a result of the reimbursement.
11. If you cancel the contract any ancillary contracts are automatically terminated without any cost for you unless you requested my services to commence before the end of the Cancellation period.
